1. Acceptance of Terms

By downloading, installing, or using the Unstuck application ("App") or visiting go-unstuck.com ("Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App or Site.

These Terms form a legally binding agreement between you and Unstuck ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the App or Site after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Unstuck is a group decision-making application that enables users to create polls, vote on options, break ties automatically, and reach faster group consensus. Features include budget-aware filtering, calendar sync, and real-time collaborative voting.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice or liability.

3. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13.

4. Account Registration

Some features require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use at [email protected].

5. Subscription Plans and Billing

Unstuck offers the following subscription tiers:

• Rift — up to 3 people
• Guild — up to 6 people
• Crown — up to 15 people
• Realm — up to 40 people (additional per-person fee applies above 40)

Subscriptions are billed monthly or annually as selected at checkout. Prices are displayed in USD. We reserve the right to change pricing with 30 days' notice. Your continued use of a paid plan after a price change constitutes acceptance of the new price.

Free trials are available as indicated at signup. Trials automatically convert to paid subscriptions at the end of the trial period unless cancelled beforehand.

6. Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Cancellation takes effect at the end of the current billing period; you retain access until that date.

Payments are non-refundable except where required by applicable law. If you believe you were charged in error, contact us within 30 days of the charge.

7. Acceptable Use

You agree not to use the App or Site to:

• Violate any applicable law or regulation
• Harass, abuse, or harm any person
• Transmit spam, malware, or any unauthorized advertising
• Attempt to gain unauthorized access to our systems or other users' accounts
• Scrape, reverse-engineer, or decompile any part of the Service
• Use the Service for any commercial purpose not expressly permitted by us

We reserve the right to suspend or terminate accounts that violate these rules without refund.

8. User Content

You retain ownership of any content you submit (decision titles, options, group names, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display that content solely to operate the Service. You represent that your content does not infringe any third-party rights.

9. Intellectual Property

All trademarks, logos, design, text, graphics, and software comprising the App and Site are the property of Unstuck or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our intellectual property without our prior written consent.

10. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of personal data as described therein. We collect email addresses and subscription preferences; we do not sell personal data to third parties.

11. Third-Party Services

The Service may integrate with or link to third-party services (e.g., calendar providers, payment processors). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNSTUCK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Unstuck and its officers, directors, employees, and agents from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Unstuck is incorporated, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved through binding arbitration on an individual basis; class actions are waived to the extent permitted by law. Nothing herein prevents either party from seeking injunctive relief in a court of competent jurisdiction.

16. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page with a new "Last updated" date. Material changes will be communicated via email or in-app notice where feasible. Your continued use of the Service after the effective date of any changes constitutes acceptance.
